Chidimma Adetshina Says She Won’t Back Down As Court Postpones Deportation Case

Former Miss Universe Nigeria Chidimma Adetshina has vowed to keep fighting her immigration case despite another delay in court, saying she refuses to give up even as the legal battle continues to take an emotional toll.

Her comments came hours after the Cape Town Regional Court postponed her deportation matter to August 19, when judgment is expected to be delivered.

Beauty Queen Breaks Her Silence

Adetshina addressed the ongoing case for the first time since her legal troubles began, sharing an emotional message on Instagram.

The 25-year-old admitted that the court battle has left her mentally and emotionally drained but insisted she remains determined to see it through.

“Exhausted – yes. Burnt out – yes. Depressed – yes. Will I give up? NO!” she wrote alongside a video.

Her post marked her first public statement since her arrest and the start of the immigration proceedings.

Court Delays Deportation Matter

The latest postponement follows a ruling by the Western Cape High Court that magistrates do not have the authority to issue warrants for immigration detention, with that power resting solely with immigration officers.

The Department of Home Affairs is seeking to have Adetshina detained pending deportation, arguing that despite efforts to regularise her stay, she does not possess the required immigration documents.

State prosecutors also told the court that Adetshina remains in possession of a South African passport, which they allege she has refused to surrender.

Defence Challenges State’s Position

Adetshina’s legal team argued that it was ready to proceed with the case and maintained that the Department of Home Affairs should also have been prepared, having initiated the proceedings.

Her lawyers also submitted an affidavit detailing the steps she has taken to legalise her immigration status in South Africa.

During proceedings, Adetshina told the court that South Africa is the only home she knows.

However, the court was presented with documents which the State says show that she is able to reside in Nigeria.

Case Dates Back To 2024

The matter has been postponed to August 19 for judgment by presiding magistrate Reema Khorana.

Adetshina was arrested last month after authorities alleged that she entered South Africa illegally through the Lebombo border from Mozambique. Officials also alleged that she and her minor son were living in the country without legal immigration status.

Her immigration dispute first came into the spotlight in 2024 during her participation in the Miss South Africa pageant, when public concerns prompted the Department of Home Affairs to investigate her citizenship status.
