A former lawyer has been convicted after being found at the centre of a multi-million rand RAF client fraud. Thesaid fraud happened in a span of 3 years and the lawyer stole millions of rands from his clients.

The Mpumalanga Specialised Commercial Crimes Court has convicted former lawyer Mantladi Jo-Anne Mmela on multiple counts of theft. The verdict comes after a lengthy investigation into her systematic embezzlement of client funds from Road Accident Fund (RAF) settlements.

The Scheme: How Trust Account Privileges Were Abused

Court evidence revealed that between 2019 and 2022, Mmela exploited her position as a sole practitioner to defraud vulnerable clients. After successfully processing RAF claims on their behalf, the compensation payments were deposited into her law firm’s trust account.

Rather than distributing these funds to the rightful beneficiaries, Mmela illegally diverted over R4.1 million for personal gain.

Whistleblower Triggers Investigation

The fraudulent activity was uncovered when an alert victim reported Mmela’s failure to release their settlement payment. This single complaint sparked a comprehensive probe by authorities, culminating in Mmela’s 2022 arrest. The defendant initially secured pretrial release but later faced detention after violating bail conditions.

Prosecution Builds Watertight Case

Despite Mmela’s not guilty plea, Senior State Advocate Henry Nxumalo methodically presented irrefutable evidence, including compelling witness testimony. The prosecution’s meticulous preparation resulted in convictions on all four theft charges.

Sentencing Looms for Fallen Legal Professional

The court has scheduled sentencing proceedings for August 21, 2025, where Mmela faces potentially severe consequences for her breach of legal ethics and criminal misconduct. This case serves as a stark warning about the importance of trust account transparency in legal practice.
