A former senior police officer, Nokulunga Gumede, found herself in the Pinetown Magistrate Court, KwaZulu Natal, accused of facilitating the illegal release of an inmate who is her son from a correctional service centre.

Unauthorized Release of Inmate

Gumede, who formerly served as a branch commander with the rank of captain at the KwaMakhutha police station, faced serious allegations regarding the release of an inmate identified as her biological son.

According to Lieutenant Colonel Simphiwe Mhlongo, spokesperson for KZN Hawks, Gumede allegedly orchestrated the release of her son without proper documentation from the court. The incident, which occurred on April 17, 2020, went unnoticed by the investigating officer.

Legal Proceedings

After Gumede took her son home, bypassing the necessary legal procedures, a case of obstructing justice and unauthorized removal of an inmate was registered. The Hawks, upon receiving the case docket, promptly issued a summons for Gumede’s appearance in court.

Subsequently, on February 5, 2024, Gumede was summoned and released on a warning. The court adjourned the case to March 27 for further proceedings. It’s worth noting that Gumede has since tendered her resignation from the SAPS.

It is however not yet known if the inmate was arrested again or not at this moment.

Additional Arrest of Police Constable

In a separate incident, Constable Sherwin Chetty, aged 28, made a brief appearance in the Verulam Magistrate Court. Chetty faced charges of drug dealing and unlawful possession of ammunition following his arrest by Hawks members during a routine roadblock.

Chetty’s arrest stemmed from intelligence indicating his involvement in drug transportation. He remains in custody pending a formal bail application, with the case scheduled for March 20, 2024.
