Renowned gospel artist and radio personality Khaya Mthethwa has triumphed in a legal battle against MiWay Insurance. After nearly nine years of persistent struggle, Mthethwa has finally secured a victory in the Gauteng High Court regarding his 2016 insurance claim.

The dispute stemmed from a car accident on December 26, 2016, when MiWay refused to honour Mthethwa’s claim. Determined to seek justice, Mthethwa pursued legal action, resulting in a court ruling in his favour.

MiWay Ordered to Pay Damages and Legal Costs

The Gauteng High Court found MiWay’s grounds for rejecting Mthethwa’s claim unjustified. The court ruled that MiWay must pay damages, including the vehicle’s value, legal fees, and additional costs incurred by the gospel star.

“The plaintiff is entitled to compensation for the retail value of the vehicle, less the excess, as well as towing and storage fees, finance charges, and interest accrued due to the insurer’s repudiation of the claim.”

Mthethwa’s Public Outcry on Social Media

Frustrated by delays, Khaya Mthethwa took to Instagram on Tuesday to air his grievances. He criticized MiWay’s legal department for ignoring emails since November 2024, despite a court ruling in his favour almost a year earlier.

“@miwayinsurance I’d like to know why our emails since Nov 2024 have been ignored by your legal department? My claim was declined in 2016, and I finally got my day in court last year. We won the case! Now it’s a mission to get you guys to settle this claim. I’m sick and tired of chasing you.”

Along with his post, Mthethwa shared a copy of the court judgment, confirming that he had won the case against the insurer.

Details from the Court Judgment

The court ruling highlighted that MiWay’s reasons for rejecting the claim were unfounded. Contrary to the insurer’s accusations, no evidence proved that Mthethwa provided false information regarding the accident.

The judgment emphasized:

“There is no evidence suggesting the plaintiff supplied dishonest information about the speed or circumstances of the accident. Therefore, the insurer’s repudiation cannot be justified.”

MiWay was ordered to compensate Mthethwa fully, covering proven damages, towing fees, storage costs, and the interest accumulated since the date of the accident.

MiWay Responds Following Social Media Pressure

After Mthethwa’s social media post gained traction, MiWay quickly acted to resolve the matter. By February 5, 2025, MiWay had settled the claim and communicated with Mthethwa to finalize the details.

Updating his followers, Mthethwa expressed gratitude for the support and the power of social media:

“MiWay has settled the claim. We signed the settlement yesterday, and they’re now processing the final steps. I want to thank everyone who helped spread the word. Your support made a huge difference.
