Man Swindles Victims Out of R3 Million in Fake Property Dealings

A 58-year-old man who allegedly scammed unsuspecting victims out of more than R3 million through a fake property scheme has lost his bid for bail at the South Gauteng High Court in Johannesburg.

Candid Chilwane stands accused of operating as a bogus conveyancer, orchestrating a fraudulent operation involving fake estate agents and non-existent property sales.

Sophisticated Scam Involved Fake Estate Agents

According to IOL, between August 2023 and October 2024, Chilwane and two accomplices posed as property professionals, advertising various homes to lure buyers. Once a potential buyer expressed interest, they were referred to Chilwane, who presented himself as a conveyancer to handle the legal transaction.

All payments from the victims were deposited directly into Chilwane’s account. Initially facing eight charges, he now faces 20, with two more fraud cases opened in Pretoria for similar conduct — accepting payments for deeds of transfer that were never processed.

Victims Threatening Revenge, Says Investigating Officer

During the bail appeal, Judge Dario Dosio heard testimony from the investigating officer who warned of potential violence if Chilwane was released. The officer said some victims were armed and had made direct threats, allegedly saying they would “decide what to do with him” if he were granted bail.

One female victim even relocated to Mpumalanga, fearing for her safety after alleging Chilwane sent people to intimidate her.

Attempt to Destroy Evidence, Medical Claims Rejected

The court also heard that prior to his arrest, Chilwane attempted to collect files from his office, raising concerns that he might destroy or hide critical evidence. The officer further argued that releasing him could lead to intimidation of other victims.

Chilwane’s legal team argued that he was in poor health due to kidney issues and claimed he was not receiving medical care in custody. However, Judge Dosio dismissed these claims, citing insufficient evidence and a lack of hospital admission in the medical records.

Judge Rules Against Bail

Judge Dosio ruled that Chilwane failed to prove that his release would be in the interest of justice.

“It is the applicant who must prove that the interests of justice permit his release. I am not satisfied that he has done so,” the judge stated.

Chilwane will remain in custody as the fraud case against him continues to unfold.
