During the podcast, Baloyi made inflammatory statements regarding white people, claiming they have “Neanderthal blood” and are weaker than black people.

“They are an inferior species [compared] to us. We are Homo sapiens; they have got Neanderthal blood in them. This is science,” he stated.

He further argued that white leadership is “dying out” and that the white population is shrinking.

His remarks quickly drew criticism, leading the SAHRC to investigate whether they amounted to hate speech.

SAHRC Finds Prima Facie Case of Hate Speech

On Monday, the SAHRC confirmed that it had decided to take legal action against Baloyi.

Following the publication of the podcast, the commission opened its own-accord investigation and received complaints from across the country registered with the Gauteng provincial office,” the SAHRC stated.

“The SAHRC found a prima facie case of hate speech.”

The commission cited the Promotion of Equality and Prevention of Unfair Discrimination Act, 2000, as the legal basis for its case.

Among its demands, the SAHRC seeks:

  • A public apology from Baloyi
  • Diversity and sensitivity training
  • Community service
  • A monetary fine

Baloyi Remains Defiant

Despite the legal action, Baloyi has refused to back down, insisting he was simply stating facts. Speaking to Sunday World on Tuesday, he said:

“I take the referral of this matter to the Equality Court very seriously, as I join Julius Malema and Andile Mngxitama as other notable figures that have exposed the fragility of whiteness.”

“I cannot apologise for stating facts, and I am glad to have been able to give those with Neanderthal ancestry a much-needed racial sensitivity crash course.”
