Prominent High Court Judge Ratha Mokgoatlheng has publicly expressed regret for racial remarks made during last week’s proceedings in the high-profile Senzo Meyiwa murder case. The judicial officer’s remarks came under scrutiny after an exchange with defence counsel during trial proceedings.

The controversy arose when Advocate Charles Mnisi, representing two defendants in the case, requested an adjournment to participate in the upcoming Comrades Marathon. In response, Judge Mokgoatlheng made a contentious comparison suggesting racial differences in professional conduct.

Addressing the courtroom on Monday, the seasoned jurist acknowledged his comments were inappropriate for someone of his judicial standing. With 26 years of service on the bench, Mokgoatlheng admitted this incident marked a departure from his usual conduct.

Judge Apologizes For Insensitive Comments

“My behavior was unacceptable and reflects poorly on the judiciary,” Mokgoatlheng stated. “Even my spouse remarked that I should apologize to the nation, comparing my conduct to unethical attorneys misappropriating Road Accident Fund claims.”

The judge revealed personal circumstances that may have affected his judgment, including the recent loss of his son, who also practiced law.

“I believe my late son, an advocate himself, would have been disappointed by my remarks,” he added emotionally.

Addressing Accusations of Racism

Mokgoatlheng directly confronted allegations of racial bias stemming from his comments.

“The suggestion that I harbor racist views would astonish my late father,” he said. “If my words conveyed racism, I assure you this was unconscious. I sincerely apologize for any offense caused and commit to personal improvement.”

The judge concluded his apology with a heartfelt appeal for forgiveness from his judicial colleagues and all South Africans, emphasizing his commitment to maintaining professional decorum in future proceedings.
