GHOSTS of the past are haunting Mamelodi Sundowns midfielder Teko Modise.

That’s because a judgment has been granted against the heavily indebted former Bafana Bafana star. Modise failed to pay R80 000 in commission to property estate agent Homenet for a house he failed to buy in 2009.

According to court documents seen by Sunday World, Homenet, represented by BKZ Corporate at the Randburg Magistrate s Court on Thursday, said the talented footballer had signed an offer to purchase a house for R1 050 000 at Eastleigh suburb in Edenvale, east of Johannesburg, in July 2008. But Modise, who has a fetish for expensive cars, failed to secure sufficient funds for the property and the deal fell through, resulting in the agent losing out on commission.

In terms of clause 18, the offer was irrevocable until midnight on July 11, 2008. The sellers, Xianwen Zeng and Ping Lin, duly accepted the offer on July 10, 2008 at Eastleight, read the judgment. The offer was not suspensive upon the defendant obtaining finance for the purchase of the property. On October 3, the conveyancers attending to the transfer of the property were advised by the bond originating attorneys that the defendant did not have sufficient funds to cover the shortfall, and that the said sale could not proceed. In terms of clause 7 of the offer to purchase, the defendant is liable to pay the plantiff, as estate agent, an amount of R80 000.” Praying for the judgment to be granted, the agent s lawyers said Modise had ignored their pleas to pay the commission.

To date, despite demand attached, the defendant has failed and or, alternatively, neglected and or, alternatively, refused to make payment to the plantiff for the amount as aforesaid,” read the summons.The court granted the judgment, saying the estate agent should seek further and or alternative relief to recover their money from the footballer. Modise could not be reached for comment yesterday. That s because his team was preparing to face Orlando Pirates in a big Nedbank Cup semifinal clash last night.

His agent Jazzman Mahlakgane said Modise was not aware of the court process. Previously, Modise s palatial double storey home in Ruimsig, on the West Rand, was auctioned off by a bank, following his failure to keep up with his mortgage repayments.

After that, lenders wrestled a BMW 1 Series away from the footie for the same reason.
