Keneilwe Shalaba, a 33-year-old mother accused of human trafficking, has given birth while detained in police custody. Shalaba, who was arrested in November, faces serious charges, including human trafficking, conspiracy to commit a crime, and perjury. Her arrest followed allegations that she trafficked her two-year-old son, Kutlwano, and falsely reported him as kidnapped.
Bail Application and Pregnancy Concerns
Shalaba’s bail application has been a focal point of her legal battle. During proceedings at the Vanderbijlpark Magistrates Court, her legal team argued for her release, citing her pregnancy with twins as a primary reason. However, the State strongly opposed her bail, expressing concerns about the safety and well-being of her unborn children while in custody.

Police officials also raised alarms about potential risks to the unborn babies, emphasizing the need for proper medical care and a safe environment.
Mother accused of trafficking gives birth in custody
Earlier this week, Shalaba gave birth to one child, as confirmed by her lawyer. The mother of four is currently being held at the Sun City Correctional Centre, where she remains in custody alongside her newborn. The birth has added a new dimension to the case, as authorities now must balance legal proceedings with the health and welfare of both Shalaba and her infant.
Her bail judgment, initially scheduled for tomorrow, may face postponement to allow Shalaba time to recover from childbirth.
Legal and Ethical Implications
This case has sparked widespread debate about the treatment of pregnant women in custody and the ethical responsibilities of law enforcement. Human rights advocates have called for greater consideration of maternal health in such situations, urging authorities to ensure that detainees receive adequate medical care.
